By accessing or using our website and services ("Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. We reserve the right to modify these Terms at any time, and your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

2. Service Description

Brevlix provides AI-powered health assessment quizzes and personalized reports for functional medicine practitioners. Our platform enables practitioners to embed quizzes on their websites, collect leads, and send automated follow-up emails to prospective patients. All features and functionalities are subject to change at our discretion.

3. Third-Party AI Services

Brevlix is an independent third-party application. We are not affiliated with, endorsed by, sponsored by, or operated by any underlying AI model provider, including but not limited to Anthropic, OpenAI, Google, and DeepSeek.

We utilize third-party artificial intelligence API services to generate content and deliver functionality to our users. All services are provided independently by our platform. The AI model providers are not responsible for the content generated through our Services, and we are solely responsible for the operation and delivery of our platform.

4. User Accounts and Responsibilities

By creating an account, you agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security and confidentiality of your account credentials.
  • Promptly notify us of any unauthorized access to or use of your account.
  • Use the Services in compliance with all applicable laws and regulations.
  • Be fully responsible for all activities that occur under your account.

5. Practitioner Responsibilities

If you are a practitioner using Brevlix, you are responsible for:

  • Ensuring your appointment booking links (e.g., Calendly) are accurate and functional.
  • Obtaining proper consent before sending marketing or follow-up communications.
  • Not using the platform to send spam, unsolicited messages, or unlawful content.
  • Ensuring that any health-related content you provide complies with applicable professional standards and laws.

6. Acceptable Use and Restrictions

You agree not to, and will not permit others to:

  • Copy, modify, create derivative works of, or reverse-engineer any part of the Services.
  • Use web scraping, data extraction, or automated methods to access or collect data from the Services.
  • Use the Services or any AI-generated output to develop, train, or improve any other artificial intelligence or machine learning model.
  • Attempt to gain unauthorized access to the Services, other users' accounts, or our underlying systems.
  • Use the Services to generate or distribute content that is unlawful, harmful, defamatory, infringing, or otherwise objectionable.
  • Interfere with or disrupt the integrity or performance of the Services.

7. Fees and Payment

Certain features of the Services require payment of fees. By subscribing to a paid plan, you agree to pay all applicable fees as displayed at the time of purchase. You authorize us (and our payment processor) to charge your selected payment method for all applicable fees.

  • Subscriptions automatically renew for successive periods unless cancelled before the next renewal date.
  • You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
  • All fees are non-refundable unless otherwise required by law.
  • We may modify fees upon at least 30 days' advance notice. If you do not agree to the modified fees, you may cancel your subscription before the changes take effect.

8. Privacy and Data

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. If you provide any feedback, suggestions, or ideas about the Services ("Feedback"), you grant us a perpetual, irrevocable, royalty-free, worldwide license to use and incorporate such Feedback into our products and services without any obligation to compensate you.

10. AI Output Disclaimer

You acknowledge and agree that:

  • AI-generated outputs may be inaccurate, incomplete, biased, or otherwise unreliable.
  • You are solely responsible for reviewing, evaluating, and verifying any AI-generated output before using, distributing, or relying on it.
  • AI-generated output may not qualify for intellectual property protection and may be similar or identical to output generated for other users.
  • We make no warranty that any AI-generated output will meet your requirements or be suitable for any particular purpose.

11. No Medical Advice

Brevlix is a technology platform, not a healthcare provider. The AI-generated health assessment reports are for informational and marketing purposes only and do not constitute medical diagnosis, treatment, or professional medical advice. Practitioners are solely responsible for any clinical decisions, patient interactions, and the accuracy of any medical information they provide. Always consult a qualified healthcare provider for personal health concerns.

12. Termination and Suspension

We reserve the right to suspend or terminate your account, with or without notice, if we reasonably believe that you have violated these Terms, pose a security risk, engaged in fraudulent or illegal activity, or disrupted the Services. You may cancel your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnification, and limitations of liability.

13. Indemnification

You agree to indemnify, defend, and hold harmless Brevlix and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

14. Limitation of Liability

To the fullest extent permitted by law, in no event shall Brevlix be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Services. Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator of Brevlix is located, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.

17. Changes to Terms

We may update these Terms from time to time at our sole discretion. If we make material changes, we will notify you by posting an updated version on our website or through the platform.
